Terms of Use
1. About these terms
These terms apply to every order placed with The Deli by Greenhorns, whether it's corporate catering, event and weekend catering, or wholesale supply. By placing an order, you agree to them.
1.1 Who we are. The Deli by Greenhorns is a trading name of Greenhorns Deli Pty Ltd (ABN 93 695 725 038). In these terms, "we", "us" and "The Deli" mean Greenhorns Deli Pty Ltd.
1.2 Who you are. "You" means the person or business placing the order. If you order on behalf of a company, you confirm you're authorised to do so, and the company is responsible for payment.
1.3 Definitions.
- Order: any request for food, drinks, equipment or services that we confirm in writing (including by automated email from our website).
- Corporate Catering: orders delivered to workplaces Monday to Friday.
- Event Catering: orders for functions, parties, home and private events, including weekend catering. A Staffed Event is an Event Catering order where our team serves on site.
- Wholesale: regular supply to cafes and businesses on an approved wholesale account.
- Delivery Time: the time you choose at checkout or agree with us.
- Delivery Window: the period around the Delivery Time in which we'll deliver (see section 5).
- Business Day: Monday to Friday, excluding public holidays in Western Australia.
1.4 Separate agreements. If you have a signed supply agreement or quote with us, that document applies first and these terms fill any gaps.
2. Ordering
2.1 How to order. Order online at the-deli.com.au. For large, custom or recurring orders, email [email protected] or call 08 6107 5799.
2.2 Lead times and cutoffs.
| Service | Order by | Minimum order |
|---|---|---|
| Corporate, event and home catering | 2pm the day before delivery | No minimum |
| Weekend catering | 2pm Friday for Saturday or Sunday | $500 |
| Wholesale | 1:30pm the day before delivery (1:30pm Saturday for Monday) | $350 per delivery |
Late orders are accepted at our discretion. We can't guarantee them, and the full menu may not be available.
2.3 Confirmation. An order is accepted once we confirm it in writing. We may decline an order (for example, if a time slot is full, we can't source an ingredient, or the address is outside our delivery area). If we decline, you won't be charged.
2.4 Time slots. We take a limited number of orders per delivery time slot so everything goes out fresh and on time. Slots are first in, first served.
2.5 Getting the details right. Please check your order, delivery address, Delivery Time, contact name and phone number before you submit. We'll deliver what's on the confirmed order.
2.6 Substitutions. Fresh produce and supply change. If an ingredient isn't available, we may swap it for something of similar or better value and quality. If a swap affects a dietary requirement or allergen, we'll contact you first.
3. Changes and cancellations
We start buying ingredients and prepping well before your Delivery Time, so late changes cost us real food and real hours. These rules are how we keep that fair for everyone.
3.1 Changing an order. Changes to quantities, items, address or Delivery Time can be made up to 48 hours before the Delivery Time by emailing [email protected] or calling 08 6107 5799. Later changes are at our discretion, and we'll tell you if they're possible before we make them. Reductions inside 48 hours are charged at the original order value.
3.2 Cancelling an order.
| Service | Notice given before Delivery Time | What you pay |
|---|---|---|
| Corporate, event and home catering | 48 hours or more | Nothing, full refund |
| Corporate, event and home catering | Less than 48 hours | Up to 100% of the order. Get in touch and we'll see what we can do, but it may be charged in full |
| Staffed Events | More than 7 days | Nothing, full refund including any deposit |
| Staffed Events | 7 days to 48 hours | The deposit is kept |
| Staffed Events | Less than 48 hours | 100% of the order |
| Wholesale | By the order cutoff | Nothing |
| Wholesale | After the order cutoff | 100% of the order |
3.3 Recurring orders. Standing orders (for example, weekly lunches or wholesale deliveries) run until you cancel them. Cancelling a single delivery follows the table above. To end a standing order, give us 7 days' notice in writing.
3.4 If we cancel. If we have to cancel or can't fulfil your order, we'll tell you as soon as possible and refund everything you've paid for the undelivered items. If we can, we'll offer a different time or menu first.
3.5 Deposits for Staffed Events. For large Staffed Events we may ask for a deposit of 20% of the order to lock in your booking. The booking is confirmed once the deposit is paid. The deposit comes off your final invoice.
4. Prices and payment
4.1 Prices. Prices are in Australian dollars and include GST unless stated otherwise. The price you pay is the one shown when your order is confirmed. We may update menu prices, but changes won't apply to orders we've already confirmed.
4.2 Delivery fees. Corporate and event delivery fees are based on distance from our Osborne Park kitchen and are shown at checkout before you pay. Wholesale delivery is free, with a minimum order of $350 per delivery.
4.3 When payment is due.
| Account type | When to pay | How |
|---|---|---|
| No account | At checkout when you order | Card (via Stripe) or PayPal |
| Approved account | The payment terms we agree with you when your account is approved | Card, PayPal or bank transfer |
| Wholesale account | 7 days from invoice date | Card, PayPal or bank transfer |
Payment terms are offered case by case at our discretion, and not every customer will be granted them.
4.4 No card surcharges. We don't charge a surcharge for paying by card.
4.5 Late payment. If an invoice isn't paid by its due date, we'll send a reminder. If it's still unpaid 7 days after that, we may pause or decline further deliveries until the account is up to date, and we may recover reasonable collection costs.
4.6 Bank details. We will never change our bank details by email alone. If you get a message saying our details have changed, call us on 08 6107 5799 before paying. For anything about invoices or payments, contact [email protected].
4.7 Disputed invoices. If you think an invoice is wrong, let us know within 7 days and pay the part that isn't in dispute while we sort it out.
5. Delivery
5.1 Delivery Windows. Perth traffic, lifts and loading docks don't always run to the minute, so every order is delivered within a Delivery Window around the Delivery Time you choose. Delivery Times are available from 6:30am to 5pm.
| Service | Delivery Window | Example (Delivery Time 12pm) |
|---|---|---|
| Corporate, event and home catering | 30 minutes either side of the Delivery Time | 11:30am to 12:30pm |
| Staffed Events | From 45 minutes before to 15 minutes after, or a window agreed in writing | 11:15am to 12:15pm |
| Wholesale | Any time up to 9am. Exact times vary with our delivery run | Before 9am |
A delivery anywhere inside the Delivery Window is on time. If your event can't start before a certain time or the food must arrive by a hard deadline, choose a Delivery Time that allows for the window, or tell us in the order notes and we'll confirm whether we can do it.
5.2 Early arrival. Food made for an earlier arrival is packed to stay fresh until the end of its Delivery Window. Cold food leaves our kitchen chilled, and hot food is packed to hold its temperature.
5.3 If we're running late. If we think we'll arrive after the Delivery Window, we'll call or text the contact on your order as soon as we know. If we deliver more than 30 minutes after the end of the Delivery Window and the food is no longer useful to you, tell us on the day and we'll give you a credit for the affected items on your next order. If we deliver more than 90 minutes after the end of the Delivery Window, we'll refund the affected items instead. This doesn't limit your rights under the Australian Consumer Law (section 8).
5.4 Delivery area. We deliver across the Perth metropolitan area. Delivery outside the metro area is at our discretion, case by case, and may cost more.
5.5 Receiving the delivery. You agree to:
- make sure there's a suitable drop-off location, and describe it in your order's delivery notes along with the full address, level, building name and any access instructions (loading dock, security, lift passes, parking);
- have someone available to receive the order across the whole Delivery Window, with a working contact number;
- tell us about anything that will slow us down, such as security sign-in or long walks from parking.
Paid parking or access fees needed to complete a delivery may be added to your order at cost.
5.6 If we can't deliver. If we arrive within the Delivery Window and can't hand over the order (nobody available, no access, wrong address), we'll try your contact number and wait up to 10 minutes. After that we may leave the order with reception or another responsible person, or take it back to the kitchen. Either way the full order price is payable, and a second delivery attempt will be charged as a new delivery fee. For food safety reasons, food we take back can't be resold or redelivered.
5.7 Wholesale and unattended delivery. If you've asked us to deliver before you open (for example, into a cool room or a secure drop point), the order is treated as delivered when we leave it at the agreed spot. You're responsible for it from then on.
5.8 Responsibility after delivery. Once your order is handed over or left as agreed, it's your responsibility, including how it's stored and served.
5.9 No pickup. All orders are delivered. We don't offer pickup from our kitchen.
6. Food safety, allergens and dietary requirements
6.1 Keeping food safe after delivery. Our food is made fresh to be eaten on the day. Once it's delivered:
- keep cold food in the fridge (5°C or below) until you're ready to serve;
- hot food should be served on arrival or kept at 60°C or above;
- food that has been out of temperature control for up to 2 hours can be used or refrigerated, between 2 and 4 hours it should be used straight away, and after 4 hours it should be thrown out;
- don't keep leftovers that have been sitting out.
We can't be responsible for illness or spoilage caused by how food was stored or served after delivery.
6.2 Telling us about dietary requirements. Tell us about any allergies, intolerances or dietary needs when you order, using the order notes or by contacting us. We'll label dietary-specific items where we can.
6.3 Allergen information. You can ask us at any time for the allergen information for any item on our menu, and we'll provide it. Our kitchen handles common allergens, including gluten, milk, egg, peanut, tree nuts, sesame, soy, fish, crustacea, mollusc and lupin. Everything is made in the same kitchen. We take care to separate dietary-specific items, but we can't guarantee any item is free from gluten, nuts or any other allergen. This means our gluten free items may not be suitable for people with coeliac disease.
6.4 Your part. Please pass our labels and allergen information on to the people eating the food, and keep dietary-specific items separate when serving. Our dietary options suit most preferences and mild intolerances. Because of our shared kitchen, we can't safely cater for severe allergies or coeliac disease. If anyone eating has one, please talk to us before ordering.
6.5 Our responsibility. We're responsible for giving you accurate allergen information and for preparing your order in line with the dietary requirements you've told us about. We're not responsible for reactions caused by requirements we weren't told about, or by food being mixed, swapped or contaminated after delivery.
7. Packaging
Everything comes in disposable packaging that's compostable or recyclable. It's yours to keep, and you're responsible for disposing of it. We don't collect packaging after delivery.
8. Problems, your rights and our liability
8.1 If something's not right. Missing items, the wrong order or food that isn't up to scratch: tell us as soon as you notice, ideally on the day, by calling 08 6107 5799 or emailing [email protected]. Photos help us fix it quickly. Because our food is fresh and perishable, reporting it promptly lets us check what happened and put it right while it still matters. We'll own it and sort it out case by case, usually with a credit or a 10% discount on your next order. This doesn't limit your rights under the Australian Consumer Law (8.2).
8.2 Your rights under the Australian Consumer Law. Our goods and services come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those rights, or any other right you have that can't be excluded by law.
8.3 Limits on our liability. To the extent the law allows:
- we're not liable for indirect or consequential loss, such as lost profits, lost revenue or a missed business opportunity;
- where our goods or services aren't of a kind ordinarily bought for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited to (at our choice) supplying the goods or services again, or paying the cost of having them supplied again.
8.4 Events outside our control. We're not responsible for delays or failure to deliver caused by things we can't reasonably control, such as severe weather, road closures, major accidents, power or utility outages, or government directions. If this happens, we'll tell you as soon as we can and offer a new Delivery Time, or a full refund for anything we can't deliver.
9. General
9.1 Privacy. We collect your details to take, deliver and invoice your orders, and to send you updates if you've opted in. You can unsubscribe from marketing emails at any time. See our Privacy Policy for how we handle your information.
9.2 Photos. We sometimes photograph our food and setups for our website and socials. We'll never photograph your people or premises in a way that identifies them without asking first.
9.3 Changes to these terms. We may update these terms from time to time. The terms that apply to an order are the ones published when that order was confirmed. For standing orders and accounts, we'll give you at least 14 days' notice by email of any change that affects you, and you can cancel before it takes effect without any cancellation fee.
9.4 Governing law. These terms are governed by the laws of Western Australia, and the courts of Western Australia have jurisdiction.
